VIP Learn Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WordPress VIP Learning Portal (“Services”).  Please read these Terms carefully before accessing or using the Services. By accessing or using the Services, you agree to be bound by the Terms and all other operating rules, policies, and procedures that we may publish via the Services from time to time (collectively, the “Agreement”). You also agree that we may modify the Services from time to time and the Agreement will apply to any such modifications too. If you do not agree to these Terms, you may not use the Services.

1. Who’s Who

“You” means the individual using the Services. 

“We,” “us,” and “WordPress VIP” all mean WPVIP Inc.

2. Your Account

Using the Services requires an account. You agree to provide us with complete and accurate information when setting up your account and keep the information current so that we can communicate with you about your account. We may need to send you emails about notable updates regarding the Services. 

We consider the creation of a WordPress VIP Learning Portal account to be an inquiry about our products and services which means that we may contact you to share more details about what we have to offer (i.e., marketing). Don’t worry — if you aren’t interested, you can opt out of the marketing communications, whether it’s an email, phone call, or text message.

You’re solely responsible and liable for all activity under your account. You’re also fully responsible for keeping your password secure. We’re not liable for anything you do including any damages of any kind incurred as a result of your acts or omissions with respect to the Services.

Don’t share or misuse your access credentials. And notify us immediately of any unauthorized uses of your account or of any other breach of security. If we believe your account has been compromised, we may suspend or disable it.

3. Privacy

If you’d like to learn about how we handle the data you provide us, please see our Privacy Policy.  By using the Service, you consent to our collection and use of personal data as outlined in our Privacy Policy.

4. Minimum Age Requirements

You must be at least 18 years of age to use the Services.

5. Feedback

We love hearing from you and are always looking to improve the Services. When you share comments, ideas, or feedback with us, you agree that we’re free to use them without any restriction or compensation to you.

6. Intellectual Property

The Agreement doesn’t transfer any intellectual property rights to you, and all right, title, and interest in and to the Services remains solely with us. All trademarks, service marks, graphics, and logos used in connection with the Services are trademarks or registered trademarks of WordPress VIP or Automattic Inc. Using the Services doesn’t grant you any right or license to reproduce or otherwise use any such trademarks.

7. Termination

We may terminate your access to the Services at any time, with or without cause or notice, effective immediately. 

8. Disclaimers

The Services are provided “as is” and we disclaim all warranties of any kind, express or implied, to the maximum extent allowed by applicable law, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will be error free or that access thereto will be continuous or uninterrupted. Your use of the Services is at your sole risk.

9. Jurisdiction and Applicable Law.

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of the Services will be governed by the laws of the state of California, U.S.A., excluding its conflict of law provisions and the application of the United Nations Convention of Contracts for the International Sale of Goods, and the proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in San Francisco County, California, U.S.A. Nothing in this Agreement affects your rights as a consumer to rely on mandatory provisions in your country of residence.

10. Limitation of Liability

In no event will we be liable with respect to the Services or any other subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) interruption of use or loss or corruption of data; or (iv) any amounts that exceed $50. We shall have no liability for any failure or delay due to matters beyond our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

11. Miscellaneous

The Agreement constitutes the entire agreement between WPVIP Inc. and you concerning the Services. If any part of the Agreement is unlawful, void, or unenforceable, that part is severable from the Agreement, and does not affect the validity or enforceability of the rest of the Agreement. A waiver by either party of any term or condition of the Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. We may assign our rights under the Agreement without condition. You may only assign your rights under the Agreement with our prior written consent.


VIP Beta Test Taker Terms of Service

These Terms of Service (“Terms”) govern your participation in the WordPress VIP Certification Program (the “Program”) including taking the Beta Exam offered as part of the Program (“Exam”). 

Please read these Terms carefully before accessing the Exam. By accessing the Exam, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Exam.

1. Who’s Who

“You” means the individual taking the exam and participating in the Program. 

“We,” “us,” “WPVIP,” and “WordPress VIP” all mean WPVIP Inc.

“Kryterion” is the assessment platform provider used by WordPress VIP to administer the Exam both for online proctored and in-person exams delivered in test centers.

2. Confidential Information

The content of the Exam, including questions, answers, or any communication, oral or written, regarding or related to the Exam is WPVIP’s confidential information. You will not disclose or transmit such confidential information to, or share it in any format with, any other person. You may use Exam content only for the purpose of taking the Exam to demonstrate your knowledge and skill in the content area assessed by the Exam for the purposes of the beta test. You may not use Exam content for any other purpose, including publishing, copying, selling, posting, downloading or transmitting any Exam content, in whole or in part, by any means for any purpose.

3. Beta Exam Retake Policy

If you fail the Exam on your initial attempt you will be entitled to re-take the Exam one more time for free. You will not be permitted to retake it again if you fail your second attempt.

4. Prohibited Behavior.

a. You must not:

i. Provide false identification
ii. Provide invalid payment

iii. Provide or accept improper Exam assistance

iv. Copy Exam content in any format

v. Remove Exam content or materials in any format from a testing center

vi. Share Exam content in any format (including content that you memorize) with anyone else, including through online posts, discussion groups, forums, chat rooms, or blogs

vii. Use or access any unauthorized Exam content shared by someone else, including content that you find online, in discussion groups, forums, chat rooms, or blogs

viii. Engage in harassing, threatening, or physically or verbally abusive behavior towards Exam facilitators, proctors, other Program or support staff, or other examinees or Program participants

ix. Allow unauthorized software to run during an Exam that is an indication of proxy test-taking, or use or run any software or hardware during the Exam that compromises the integrity of the Exam 

x. Use any artificial intelligence software, program or application in any way during the Exam

xi. Otherwise violate these Terms

b. During an Exam, you may not:

i. Read Exam content out loud

ii. Take notes of any kind

iii. Intentionally disrupt other examinees

iv. Talk to or communicate with anyone who is not the Exam facilitator or proctor

v. Use any Exam aid, including books, paper, writing instruments or phones

vi. Leave the view of the camera (for online proctoring)

The acts listed in this Section 4 are “Prohibited Behaviors”.

5. Online Proctoring Invalidation

If you take an Exam involving online proctoring, Kryterion may suspend the Exam or invalidate the Exam results if:

a. Your video quality interferes with effective proctoring, including loss of video or poor resolution

b. Your audio quality interferes with effective proctoring, including loss of audio, poor audio, or excessive background noise

c. An unauthorized person is present in the secure Exam area

d. You use an unauthorized test aid, such as a prohibited keystroke or series of keystrokes (print screen, copy, paste, etc.)

e. Unauthorized software or hardware is detected on your computer

6. Data Forensics. 

Data forensics uses statistical methods to analyze digital data to detect anomalies. Kryterion will use data forensics and other statistical analyses on the Exam. If anomalies or suspicious behavior is detected, the Exam may be suspended, or the results may be invalidated. To protect the security of our processes, we will not disclose specific details about the data forensics, statistical analyses or suspicious activity giving rise to the suspension or invalidation, unless required to do so by applicable law.

7. Violations. 

If you have engaged in any Prohibited Behavior or your conduct otherwise risks the integrity of the Program, we may, in addition to any other legal remedies: (i) suspend any Exam you are taking, (ii) invalidate the results of any Exam you have taken, (iii) invalidate and revoke any or all of your Certifications, and (iv) suspend or permanently bar you from participating in the Program, including taking or retaking Exams. We will not refund any testing fees if you have engaged in Prohibited Behavior. 

8. Governing Law. 

These terms shall be deemed to have been made in, and shall be construed pursuant to, the laws of the State of California and the United States without regard to conflicts of laws provisions thereof. Any dispute, controversy or claim arising out of or relating to this Agreement will be made exclusively in the state or federal courts located in San Francisco, California, and the parties hereby submit to the jurisdiction and venue of such courts. 

9. Privacy. 

Kryterion collects and processes certain personal information from test takers to administer the Exam and enable participation in the Program. Kryterion’s Privacy Policy explains the types of data it collects and how Kryterion will use that data. By taking the Exam, you consent to Kryterion’s collection and processing of such data in accordance with its Privacy Policy.

10. Use of the Certification 

You may use the Certification only to represent that you as an individual are accredited, certified, or credentialed by WordPress VIP for passing an Exam. Corporations, companies, organizations and other entities are not permitted to use Certifications to represent themselves as accredited, certified, or credentialed by WordPress VIP. 

11. Disclaimer; Limitation of Liability

You acknowledge that the Exam is provided “as is” and without any warranties of any kind. We do not guarantee that the Exam will measure any particular skills or that any certification will be recognized or produce any employment or commercial outcome. To the fullest extent permitted by law, WordPress VIP and its affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, business, data, or opportunity, arising out of or in connection with the Exam. In all cases, our total aggregate liability arising from or related to the Exam shall not exceed the fee you paid to take the Exam.
